Questions - It has been argued that the deletion of the remedy of avoidance in section 17 of the Marine Insurance Act 1906 has the potential to make the section more important than ever (Baris Soyer & Andrew Tettenborn, 'Mapping (utmost) good faith in insurance law - future conditional?' (2016) 132 LQR 618. The opposite has also been argued (Margaret Hemsworth, 'The fate of "good faith" in insurance contracts', [2018] LMCLQ 143).
Critically discuss the scope for a future role of section 17.
