Question:
It is not possible to give effect to informal trusts of land. Paul v Constance [1976] EWCA Civ 2 established that effect could be given to informal trusts of personal property if circumstances justified it.
By allowing Mrs. Paul to claim half of the bank account that she shared with Mr. Constance, a fair and equitable result was reached by the court.
This flexibility for personal property is entirely justifiable; the lack of it for land is not.
